Terms of service.

These Terms govern your use of thedailycapital.co and the Service, operated by The Daily Capital LLC, a Florida limited liability company. By accessing or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or guardian, who agrees to these Terms on your behalf.
2. Your account
We sign you in with one-time email links, so keep access to your email secure. You are responsible for activity under your account and agree to provide accurate information. One account per person.
3. Educational content — not financial advice
The Service is for education only. Nothing on The Daily Capital — including lessons, quizzes, the AI assistant, the newsletter, or any other content — is financial, investment, tax, legal, or accounting advice, or a recommendation to buy, sell, or hold any security or asset. We are not a financial advisor, broker-dealer, or fiduciary, and using the Service does not create an advisory relationship. You are solely responsible for your own financial decisions and should consult a licensed professional before acting on anything you find here.
4. Capital+ subscriptions and payment
Some features are part of Capital+, our paid subscription, offered as a monthly plan, an annual plan, or a one-time lifetime purchase. Payments are processed by Stripe; we never see or store your full card details.
Monthly and annual plans renew automatically at the then-current price until you cancel, and you authorize us to charge your payment method each billing cycle. You can cancel anytime from your account — cancellation stops future renewals, and your access continues until the end of the current paid period. We may change prices, with notice where required by law. Refunds are governed by our Refund Policy.
5. Classrooms
Educators who create classes are responsible for how they use the Service with students and represent that they have any authority or permissions required to enroll them. Students may leave a class at any time. See our Student Data & FERPA page for how we handle data in an educational setting.
6. Acceptable use
Don’t misuse the Service. You agree not to:
- Use the Service for any unlawful, harmful, harassing, or abusive purpose.
- Break, disable, scrape, overload, or reverse-engineer the Service, or bypass its security or access controls.
- Copy, reproduce, redistribute, or resell our lessons, quizzes, or other content without permission.
- Manipulate, cheat, or attempt to game XP, streaks, quiz scores, or rankings.
- Sell or transfer your account, or impersonate any person.
- Use the Service to advertise or sell goods or services, or to send spam.
7. Intellectual property
The Service — including its lessons, quizzes, design, and brand — is owned by The Daily Capital LLC and protected by copyright and trademark law. We grant you a personal, non-commercial license to access and use it. You keep ownership of the content you submit and grant us the permission needed to use it to operate the Service.
8. Third-party links
The Service may link to third-party websites or content we don’t control. We’re not responsible for their content, accuracy, or privacy practices, and a link is not an endorsement. If you visit them, you do so at your own risk.
9. Termination
You may stop using the Service anytime. We may suspend or end access if you violate these Terms or to protect the Service or other users.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind. We do not guarantee it will be uninterrupted, error-free, or that the content is complete or accurate.
11. Limitation of liability
To the fullest extent permitted by law, The Daily Capital LLC and its team are not liable for any indirect, incidental, special, consequential, or punitive damages, or any lost profits or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us, if any, in the six (6) months before the claim arose. Some jurisdictions don’t allow these limits, so they may not fully apply to you.
12. Dispute resolution and arbitration
Most concerns can be resolved quickly — please contact us first. For any dispute, you and we agree to attempt informal resolution for at least 30 days before starting arbitration.
If that doesn’t resolve it, the dispute will be settled by binding arbitration administered by the American Arbitration Association, on an individual basis. You and we waive the right to a jury trial and to participate in a class action. This section doesn’t apply to disputes about intellectual property or requests for injunctive relief, which may be brought in court. Arbitration will take place in Florida, and any claim must be brought within one (1) year of when it arose.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules.
14. Changes
We may update these Terms. For material changes, we’ll take reasonable steps to notify you, such as by email or a notice on the Service. Continued use after changes means you accept them.
